Electronic Communications Policy

This Electronic Communications Policy is incorporated into, and forms a part of, the Terms of Use that apply to you (the “Terms”). Capitalized terms used in this Electronic Communications Policy but not otherwise defined in this policy will have the meanings given to them in the Terms.

This policy describes how Passport Club delivers all communications to you electronically. We may amend this policy at any time, as described in the Terms.

1. Information Passport Club May Send You

Passport Club may send you communications about your use of our Services, your Account, and other information, including information regarding our Terms, Privacy Policy, billing statements (if applicable), transaction information, privacy and legal disclosures, and other notices, policies, and legal documentation (“Communications”).

2. Communications Will Be Sent To You Electronically

You agree and consent to receive all Communications electronically. Passport Club may provide you with Communications by (a) emailing them to you at the email address associated with your Account; (b) posting them to our Website or within our App(s); or (c) making them available to you via an attachment, website, or link which we provide to you in an email.

You agree that all Communications sent to you electronically will have the same effect as if you had received the communication on paper, and that by sending the Communication electronically we satisfy any legal obligation that such communications be delivered to you in writing. If we request your consent to or acknowledgement of any Communications electronically, via a digital signature or other demonstration such as ticking a box, you agree that this will satisfy any applicable legal obligation to collect your signature, and will have the same effect as signing an agreement on paper.

3. Technical Requirements to Receive Communications Electronically

In order to receive Communications electronically, you must have all of the following:

a. A computer or mobile device with an active internet connection.

b. A current version of an internet browser (i.e., Chrome, Firefox, etc.) with cookies enabled, that includes 128-bit encryption.

c. A current version of a PDF reader (i.e., Adobe Acrobat, etc.).

d. A valid, working email address. If you have an Account, this must be the email address associated with your Account.

e. Adequate data storage space on your computer, mobile device, or other data storage system to save such Communications, and/or a printer installed to print and save such communications for your records.

4. How To Withdraw Your Consent to Receive Electronic Communications

You may withdraw your consent to receive Communications electronically by writing to us at “Attn: Legal Dept. / Electronic Communications Policy, thepassportclubco@gmail.com”

If you withdraw your consent to receive Communications electronically:

a. Passport Club will process your request within a reasonable period of time; and

b. Passport Club reserves the right to close your account or restrict your access to our Services, and/or to charge you reasonable fees for paper copies of Communications.

In order for Passport Club to send you paper copies of Communications, you must have a current mailing address included on your Account, or, if you don’t have an Account, you must include one in your withdrawal request.

5. Your Contact Information

You must keep the email address associated with your Account current and up to date at all times. You agree that if Passport Club sends you Communications electronically to your email address, but you don’t receive them because the address is not current, that Passport Club is not responsible for your failure to receive the Communication. Any Communications sent to the email address associated with your Account will be deemed to have been received by you.
